Concurrence of Criminal Activity and its Punishing

Anotace:

Diplomová práce se zabývá institutem souběhu trestných činů a jeho trestáním. Hlavním cílem práce je rozbor současné právní úpravy souběhu trestných činů a její zhodnocení včetně návrhů na budoucí změny právní úpravy. Diplomová práce vymezuje pojem souběhu trestných činů, jeho základní znaky, kterými se liší od jiných podobných institutů, a zabývá se jeho funkcemi jak z hlediska viny, tak z hlediska trestu. Další část práce je věnována jednotlivým druhům souběhu trestných činů a důvodům, které vedou k vyloučení souběhu. Významná část práce se zabývá rozborem právní úpravy trestání souběhu trestných činů včetně zásad, které se při jeho trestání uplatňují. Součástí diplomové práce je i srovnání české právní úpravy souběhu trestných činů s právními úpravami tohoto institutu v jiných zemích.

Abstract:

The thesis deals with the concurrence of crimes and its punishing. The main aim of the thesis is the analysis of current legal regulation of the concurrence of crimes and its assessment including suggestions of future amendments. The thesis defines the term concurrence of crimes, its main attributes, which distinguish it from other similar institutes, and the thesis also explores functions of the concurrence of criminal activity in terms of guilt and punishment. Another part of the thesis examines certain types of concurrence of crimes and reasons for exclusion of concurrence of criminal activity. The significant part of the thesis deals with the analysis of current legal regulation of punishing of the concurrence of crimes including principles used in its punishing. The part of the thesis is also the comparison between the Czech legal regulation of the concurrence of crimes and legal regulations of this institute in other countries.
