Vyrovnání s minulostí a tranzitivní spravedlnost v České republice

Abstract:

Hlavním záměrem předložené diplomové práce je analýza procesu vyrovnání se s československou minulostí prostřednictvím perspektivy nabízené konceptem tranzitivní spravedlnosti, který je definován v první kapitole. Ve druhé kapitole se práce se soustředí na ty prostředky tranzitivní spravedlnosti, které byly použity v Československu i v České republice ve snaze vyrovnat se s minulostí. Použité prostředky jsou hodnoceny zejména na základě toho na kolik se jim podařilo dosáhnout relevantních cílů tranzitivní spravedlnosti, a z hlediska jejich dopadu na existenci právního státu v České republice. Ve třetí a poslední kapitole se práce zabývá dopady, které snahy o vyrovnání se s minulostí mají na existenci právního státu a českou politickou scénu v současné době. Zvláštní důraz je kladen na lustrace, které jsou v české politice i nadále velmi ožehavým tématem.

Abstract:

The main aim of the presented Master's thesis is to analyze the process of dealing with the Czechoslovak past through the perspective offered by the concept of transitional justice, which is defined in the first chapter. In the second chapter, the dissertation focuses on the transitional justice mechanisms that were used in Czechoslovakia and the Czech Republic in order to deal with its past. The means used are evaluated mainly on the basis of how they managed to achieve their respective transitional justice objectives, and in terms of their impact on the rule of law in the Czech Republic. In the third and last chapter, the thesis deals with the impact that the efforts to deal with the past have had on the rule of law and the current Czech political scene. Special emphasis is placed on lustrations, which remain a very delicate issue in Czech politics.
