Abstract:

Bakalářská práce nese název „Žaloba v podnikatelských vztazích.“ Hlavním cílem bylo analyzovat žalobu z pohledu jejího obsahu a uplatnění žaloby při řešení sporů mezi podnikateli při jejich podnikatelské činnosti. Úvod práce je věnován historickému vývoji žaloby až do současné podoby. Následně je předmětem zkoumání samotný institut žaloby, dále druhy žalob a konečně je rozebírána nosná část této práce, a to rozbor žalob mezi podnikateli. V práci jsou obsaženy jednak dílčí závěry, ale především i konečný závěr k dané tématice. Jde o to, že přijetím nového občanského zákoníku došlo k významnému posunu v žalobním právu a cílem této práce bylo na tuto skutečnost zareagovat.

Abstract:

The bachelor thesis is titled „Action in business relationships.“ The main objective was to analyse the action in terms of its content and implementation of the action in solving disputes between entrepreneurs in their business activities. The introduction of the thesis is devoted to the historical development of the action until the current form. Subsequently, the thesis researches the institute of action, the types of actions, finally, it discusses and analyses the principal part of this work – actions among entrepreneurs. The work does not containonly partial conclusions, but also the final conclusion on the subject matter. The adoption of the new Civil Code has been a significant shift in the action law and the aim of this thesis was to react to this fact.
