Social dangerousness of the crime as material corrective
Abstract:
Práce rozebírá historický a současný pohled nejenom na materiální a formální pojetí trestného činu, ale také vztah k principu oportunity a legality, analogii vzhledem k materiálnímu pojetí, zabývá se společenskou nebezpečností i z pohledu navrhovaného materiálního korektivu. Tyto vymezené skutečnosti jsou v závěru práce zhodnoceny v podobě kladů a záporů jednotlivých pojetí trestného činu.
Abstract:
Work construes historical and contemporary look not only on material and formal conception crime, but also relation to principle oportunity and authentication, analogy regarding material conception, deal with social inadvisability and from look suggested material corrective. These determinate matter are at the close work reviewed in form thesis and negatives single conception crime.
