Bill of exchange as a payment tool

Abstract:

Bakalářská práce se zabývá směnkou a jejím využitím jako platebního prostředku. Úvodní část bakalářské práce je zaměřena na obecnou historii směnky a na její využívání v minulém století v České republice. Další kapitoly práce pojednávají o zákonem stanovených náležitostech směnky, jejichž neuvedení případně nenahrazení v souladu se zákonem směnečným a šekovým, činí směnku neplatnou. Následuje charakteristika směnky jako cenného papíru, její dělení podle způsobu vystavení a splatnosti. Bakalářská práce se zabývá také směnečnými operacemi, podmínkami vzniku směnečného práva a směnečných závazků a následně i postupem při soudním vymáhání nároků ze směnky vzniklých. Praktická část bakalářské práce je zaměřena na využití směnky v současnosti a to hlavně z hlediska jejího využívání jako platebního prostředku u směnečného inkasa a eskuntu směnky.

Abstract:

This thesis deals with the bill of exchange and its use as a means of payment. The introductory part of this thesis focuses on the general history of the bill and its use in the last century in the Czech Republic. Other chapters deal with the statutory requisites of promissory notes, the omission or non-recovered in accordance with the Act of Exchange and Cheque Act, the bill is null and void. An overview of the bills as security, its division by way of issue and maturity. This thesis deals with the bill of exchange transactions, the terms of bill of right and obligations of the promissory notes and subsequently the procedure for judical enforement of claims arising from the bill. The practical part of this thesis is focused on the use of bills today, and especially in terms of its use as a means of bill payment receipts and bill discounting.
