Protection of classified information

Abstract:

Předmětem této diplomové práce je právní úprava ochrany utajovaných informací v ČR. V úvodu je zamyšlení, jak asi vznikaly potřeby utajovat některé informace, poté je stručně uvedeno, jak byla ochrana utajovaných informací na našem území zajištěna v minulosti. V diplomové práci je popsán rozsah současné právní úpravy v oblasti utajovaných informací, zabývá se vymezením základních pojmů, jakými stupni utajení jsou chráněny utajované informace, podmínkami zajištění ochrany utajovaných informací z hlediska personální, průmyslové, fyzické a administrativní bezpečnosti, v rámci které se zmíním i o označení utajovaných skutečností v některých dalších zemích, se kterými ČR spolupracuje, o bezpečnosti informačních a komunikačních systémů a kryptografické ochraně. Součástí práce je i stanovení obecných povinností všech osob v oblasti utajovaných informací. Dále se práce zabývá státními institucemi vykonávajícími státní správu v oblasti ochrany utajovaných informací, bezpečnostním řízením, na základě kterého je subjektům umožněn přístup k utajovaným informacím. Poté jsou v práci uvedena protiprávní jednání, kterými lze dle právního řádu ČR ohrozit utajované informace, a tato protiprávní jednání jsou popsána.

Abstract:

The subject of this diploma thesis is the regulation of law relating to the protection of Classified information in the Czech Republic. In the introduction, a reflection on how the need to classify some information probably arose, then it is briefly stated how the protection of Classified information in our territory has been ensured in the past. In the thesis the scope of the current legislation in the field of Classified information is stated it deals with the definition of basic concepts, the degree of classification of classified information, the conditions for ensuring the protection of Classified information in terms of personnel, industrial, physical and administrative security, in scope of which it also mentions the designation of Classified information in other countries which the Czech Republic cooperates with, also give attention to the security of information and communication systems and cryptographic protection. The thesis also includes the determination of general obligations of all persons in the field of Classified information. The thesis also deals with the state institutions performing the state administration in the field of protection of classified information and the security management on a basis of which subjects are allowed access to Classified information. In the conclusion the illegal actions that may endanger Classified information according to the legal order of the Czech Republic are stated.
