Banking license in the Czech Republic, European Union, Switzerland and China

Abstract:

Bakalářská práce se zabývá bankovní licencí v obecné rovině, důvody pro její existenci a také omezeními. Definuje bankovní licenci a popisuje její nejdůležitější součásti, jednotlivé licenční požadavky, které musí finanční instituce splnit, aby získaly statut banky. Dále se práce zabývá určením rozdílností v definici banky a licenčními požadavky, které jsou v mnoha ohledech stejné nebo podobné, ale mají také zásadní odlišnosti. Rozdíly a podobnosti se zkoumají v České republice, Evropské unii, ve Švýcarsku a v Čínské lidové republice. Požadavky se odlišují podle přístupu země, jejich cílů nebo třeba politického systému. Odlišnosti jsou zejména v požadovaném minimálním kapitálu nebo v požadavcích na management, a tím se ovlivňuje vstup finančních institucí do bankovního sektoru v dané zemi. Také jsou zde vysvětlena a analyzována specifika jako princip jednotné evropské licence. Metodou zkoumání těchto skutečností je porovnání legislativy ve vybraných státech.

Abstract:

Bachelor thesis deals with the banking license in general, the reasons for its existence and the limitations. It defines a banking license and describes its most important components, the individual licensing requirements that financial institutions must meet to obtain a status of a bank. Furthermore, the work deals with the determination of differences in the definition of the bank and licensing requirements, which are in many aspects the same or similar, but also have fundamental differences. Differences and similarities are examined in the Czech Republic, the European Union, Switzerland and the People's Republic of China. Requirements vary according to the country's approach, their goals or, for example, the political system. The differences are mainly in the required minimum capital or management requirements, which affects the entry of financial institutions into the banking sector in each country. Specifics such as the single European license principle are also explained and analysed here. The method of examining these facts is to compare legislation in selected countries.
