Private legal means of protection against unfair competition

Abstract:

Diplomová práce se věnuje tématu práv na označení a jejich ochraně proti nekalé soutěži. Vybrané téma se dotýká problematiky možnosti existence shodně znějících, avšak co do důvodu ochrany rozdílných práv na označení, která se vyskytují vedle sebe jako identifikátory různých entit v obchodním styku. Řešení této problematiky má své opodstatnění v narůstajícím počtu registrovaných ochranných známek a neméně narůstajícímu počtu obchodních firem. Mohou tak stále více nastávat rozpory mezi těmito právy na označení, která se v obchodním prostředí nevyhnutelně potkávají. Význam vybraného tématu je zřejmý. Každý podnikatel usiluje o svou jasnou identifikaci na trhu bez jakýchkoliv neoprávněných vstupů do jeho identifikace. Diplomová práce se bude zabývat možností ochrany před těmito zásahy. Teoretická část práce bude zaměřena na vymezení jednotlivých práv na označení, charakteristiku nekalé soutěže a soukromoprávní prostředky ochrany proti porušení práva na označení. Praktická část práce bude orientována na rozbor judikatury, která se váže k danému tématu. Cílem diplomové práce je zjistit možnosti koexistence ochranné známky a obchodní firmy se stejnými definičními prvky různých vlastníků, vymezit možnosti zamezující vzájemné kolize a definovat soukromoprávní ochranu při již vzniklém rozporu. Výzkumná otázka: Lze z pohledu nekalé soutěže zapsat do obchodního rejstříku obchodní firmu, pokud je registrována ochranná známka se stejným zněním a naopak? Jsou tato práva na označení vzájemně napadnutelná?

Abstract:

The thesis deals with designation rights and the protection thereof against unfair competition. The selected topic analyses the possibility of designations that sound alike, but entail different grounds for protection, coexisting side by side as identifiers of different entities in commercial relations. The very issue is becoming ever more relevant due to the increasing number of registered trademarks and the growing number of commercial companies. This creates increasing conflicts between such designation rights, which inevitably meet in the business landscape. The importance of the selected topic is self-evident. Every business seeks to clearly identify itself in the marketplace and prevent any unwarranted interference with its identification. The thesis will look into the potential mechanisms of protection against such interference. The theoretical part of the paper will attempt to define the individual rights to designations, the features of unfair competition and private-law remedies against infringements of such rights. The practical part will then analyse relevant case law. The aim of the paper is to determine the potential coexistence of a trademark and a corporate name having the same defining elements pertaining to different owners, to define the possibilities preventing mutual conflicts and establish the available private-law resolutions in the event of an already existing conflict. Research question: From the viewpoint of unfair competition, cancorporate name be registered in the Companies Register if a trademark with identical wording is already registered and vice versa? Are these rights to designation mutually contestable?
