Human Rights in the European Union: Fundamental Rights Agency

Abstract:

Diplomová práce mapuje současný stav lidskoprávní politiky Evropské unie a zamýšlí se nad přínosností plánovaného nového orgánu - Agentury pro základní práva. Práce si klade výzkumnou otázku, zda existuje prostor pro vznik nového lidskoprávního orgánu na úrovni Evropské unie, a jestliže ano, zda předložený návrh Agentury pro základní práva tento možný prostor opravdu zapluje. Z informací vyplývajících při zkoumání právních základ lidskoprávní politiky a praktického provádění této politiky vyplývá, že prostor pro takovýto orgán skutečně existuje. Pohled na konkrétní řešení Agentury pro základní práva v návrhu Komise ale naznauje, že navrhovaná podoba nezacelí úpln mezeru, která v lidskoprávní politice EU existuje.

Abstract:

The master thesis deals with the current European Unions human rights policy and considers the added value of the newly proposed body - Fundamental Rights Agency. The research question is Is there a gap in the EU human rights policy open for the establishment of a new human rights body, if yes, does the proposed Fundamental Rights Agency fill this gap? Data from examination of the legal foundations the human rights policy and an actual human rights practice suggests that there is really such a gap. The draft of the Fundamental Rights Agency shows though that the new body would not be able to fill the gap in the policy.
