Examination of a recovered stolen vehicle.

Abstract:

Tato bakalářská práce se zabývá problematikou procesu ohledání nalezeného odcizeného vozidla, kriminalistických stop, které mohou být při tomto nalezeny, jejich charakteristikou, způsoby jejich vyhledávání, zajišťování, vyhodnocování a jejich přínosem. Dále pak právní kvalifikací trestných činů, které mohly být v souvislosti s odcizením motorového vozidla spáchány, a rozdíly v jejich skutkových podstatách. Cílem práce je uvedené začlenit do samotného ohledání nalezeného odcizeného vozidla, a zjistit, jestli a jak se může ohledání a kriminalistické stopy podepsat na určení správné právní kvalifikace daného skutku. K dosažení tohoto výsledku práce pracuje s odbornou literaturou, včetně komentářové, důvodovými zprávami příslušných zákonů, rozhodnutími Nejvyššího soudu, a závěrečnými pracemi jiných studentů vysokých škol.

Abstract:

This bachelor thesis deals with the issue of the process of examination of a stolen vehicle, the criminalistic traces that can be found during this process, their characteristics, methods of their search, securing, evaluation, and their contribution. Furthermore, the legal qualification of the offences that may have been committed in connection with the theft of a motor vehicle and the differences in their constituent elements. The aim of this thesis is to incorporate the above into the actual examination of the recovered stolen vehicle, and to see if and how the examination and the criminal traces can play a role in determining the correct legal qualification of the offence in question. To achieve this result, the thesis works with various literature, including commentary literature, explanatory reports of relevant laws, decisions of the Supreme Court, and the theses of other university students.
