Abstract:

Diplomová práce se zaměřuje na trestné činy proti životu a zdraví spáchané z nedbalosti, které jsou v českém trestním zákoníku upraveny v hlavě I. Ochrana života a zdraví je jedním z nejdůležitějších základních práv. Nedbalostní forma zavinění se v podobě známé v českém právním řádu začala objevovat již v 19. století. Diplomová práce je rozdělena do sedmi kapitol, které se snaží nastínit problematiku trestných činů proti životu a zdraví spáchaných z nedbalosti. V diplomové práci jsem si k popisu vybrala šest trestných činů. Dále jsem pracovala se soudními rozhodnutími, která se zabývala problematikou nedbalostního zavinění. Za nejdůležitější považuji třetí, čtvrtou a pátou kapitolu. Třetí kapitola se zabývá nedbalostním zaviněním; český právní řád zná vědomou nedbalost a nevědomou nedbalost. Rozdíl mezi těmito formami zavinění je významný. Vědomá nedbalost je - vědomí, že může způsobem uvedeným v trestním zákoně porušit nebo ohrozit zájem chráněný takovým zákonem, ale bez přiměřených důvodů spoléhá, že takové porušení nebo ohrožení nezpůsobí. Nedbalost nevědomá - nevěděl, že svým jednáním může takové porušení nebo ohrožení způsobit, ačkoliv to vzhledem k okolnostem a svým osobním poměrům vědět měl a mohl. Čtvrtá kapitola se zabývá vybranými nedbalostními trestnými činy a pátá kapitola se věnuje výše uvedené judikatuře. Judikatura se zaměřila na dopravní nehody, lege artis a pracovní úrazy Součástí práce je i srovnání s jinými právními předpisy. Vybrala jsem si právní úpravu Spojených států amerických, která má odlišný právní systém než právní úprava evropského kontinentu. Cílem této práce bylo podat komplexní analýzu aktuální problematiky trestných činů proti životu a zdraví spáchaných z nedbalosti.

Abstract:

The diploma thesis focuses on crimes against life and health committed through negligence, which are regulated in Czech Criminal Code in Title I. Protection of life and health is one of the most important fundamental rights. The negligent form of culpability began to appear as early as the 19th century in the form known in the Czech legal system. The diploma thesis is divided into seven chapters which attempt to outline the issues of crimes against life and health committed through negligence. In my thesis I have chosen six crimes to describe. In addition, I have worked with court decisions that have dealt with the issue of negligent culpability. I consider the third, fourth and fifth chapters to be the most important. The third chapter deals with negligence; the Czech legal system has conscious negligence and unconscious negligence. The difference between these forms of fault is significant. Conscious negligence is - knowing that he may violate or endanger an interest protected by such law in the manner specified in the criminal law, but relying without reasonable grounds that he would not cause such violation or endangerment. Negligence without knowledge - he did not know that his conduct might cause such a violation or threat, although he should have known and could have known, given the circumstances and his personal circumstances. The fourth chapter deals with selected crimes of negligence and the fifth chapter deals with the aforementioned case law. The case law focused on traffic accidents, lege artis and work injuries The thesis also includes a comparison with other legislation. I have chosen the legislation of the United States of American, which has a different legal system than that of the European continent. The aim of this thesis was to provide a comprehensive analysis of the current issues of crimes against life and health committed by negligence.
