Right of superficies

Abstract:

Předmětem této bakalářské práce je právo stavby. Má za cíl podat ucelený výklad tohoto věcného práva k cizí věci. Součástí tohoto výkladu je nejen práva stavby samotného, ale i výklad souvisejících pojmů. V první části je práce věnovaná historii práva stavby, neboť již ve starém Římě byla zavedena tato výjimka z pravidla, že stavba je součástí pozemku. Nejen v Evropě, ale i zejména na území České republiky má právo stavby zajímavou historii. V druhé části jsou vyloženy nejdůležitější pojmy s právem stavby související. Jedná se o obecný pojem věcných práv, dále pak o pojmy stavba, stavebník a pozemek. Pro výklad dále jmenovaných pojmů je třeba se obrátit i na jiné zákony, než na občanský zákoník. Někdy je pohled jiných zákonů na tyto pojmy rozdílný. Největší část práce je věnováno vzniku, trvání a zániku práva stavby. Třetí část obsahuje sedm kapitol. Občanský zákoník je ve svých ustanoveních poměrně strohý. Velká pozornost je proto věnována smlouvě o právu stavby. Možnosti vzniku i zániku, stejně jako práva a povinnosti smluvních stran jsou zpracovány podrobně. Poslední část práce je věnována porovnání práva stavby s dalšími možnými instituty, jak zřídit stavbu na cizím pozemku.

Abstract:

The subject of this thesis is the right of superficies. It aims to give a comprehensive interpretation of this right in rem to a foreign matter. Part of this interpretation is not only the right of superficies itself, but also the Interpretation of related terms. The first part deals with the history of the right of superficies, as this exception was already introduced in the old Rome from the rule that the building is part of the land. Not only in Europe, but especially in the Czech Republic, the right of superficies has an interesting history. The second part explains the most important concepts related to the right of superficies. It is a general concept of rights in rem, then the terms construction, builder and land. For the interpretation of the following terms, it is necessary to turn to other laws than the Civil Code. Sometimes the view of other laws is different on these terms. The biggest part of the thesis is devoted to the origin, duration and extinction of the right of superficies. The third section contains seven chapters. The Civil Code is quite austere in its provisions. Great attention is therefore paid to the contract on the right of building. The possibilities for the establishment and termination of the contract, as well as the rights and obligations of the contracting parties are detailed. The last part of the thesis is devoted to comparison of the right of superficies with other possible institutes, how to set up a building on a foreign land.
