Correction of Error in the Land Register with Detailed Focus on the Correction of Error in Geodetic Information Files

Abstract:

Cílem mé bakalářské práce je popsat problematiku opravy chyby v katastru nemovitostí. Přitom se blíže zaměřuji na opravu chyby v souboru geodetických informací. Vzhledem k datu zahájení práce porovnávám právní úpravu platnou do konce roku 2013 s právní úpravou platnou od 1.1.2014. Tato nová úprava je dána rekodifikací právního řádu v souvislosti s účinností zákona 89/2012 Sb., občanský zákoník. Práce obsahuje vymezení základních pojmů, popis historického vývoje katastrálních map, výčet správních orgánů na úseku zeměměřictví a katastru , rozdělení chyb z různých hledisek, procesní postup při opravě chyby, přehled řádných i mimořádných opravných prostředků, včetně případné soudní kontroly. Dále je zde uvedeno několik statistických údajů vztahujících se k prováděným opravám chyb. V závěru práce jsou uvedeny dva praktické příklady řešených oprav v souboru geodetických informací.

Abstract:

The aim of this barchelor thesis is to describe the legal status of error correction in the cadastre. After a short historical overview on this issue, the attention is focused on current problems of individual errors in the cadastral survey in connection with the valid legislativ active from January 1, 2014 . The theme is elaborated in detail for errors in the geometric and positional determination border plots of land as an obvious error and inaccuracy in the measurement and display of the measurement object in the cadastral map and also to errors in the registered area of land. The thesis is accompanied by appropriate examples and lessons of its application, based on experience gained in the performance of surveying activities. The last part is focused on the procedural aspect of the repair errors ordinary and extraordinary remedies and possible judicial review.
