Abstract:

Tato diplomová práce popisuje jeden ze způsobů úpravy právních poměrů rodičů k nezletilým dětem, pokud spolu rodiče nežijí, kterým je střídavá výchova. Je to jeden z nástrojů, který umožňuje zmírnit negativní dopady na nezletilé dítě po rozchodu rodičů. Pojem střídavé výchovy je zakotven v našem právním řádu od r. 1998. Střídavá výchova klade velké požadavky na děti, rodiče, na jejich kooperaci a to jak po stránce citové, tak i materiální. Tato diplomová práce se zabývá mediací, názory psychologů na střídavou výchovou, stanovením výživného při střídavé výchově, střídavou výchovou v zahraničí a zejména rozhodováním soudů a zkušenostmi soudců v záležitostech týkajících se střídavé výchovy.

Abstract:

This diploma thesis elaborates on shared parenting as one of the possible ways of adjusting the legal situation between parents not sharing the same household and their under-age children. It represents one of the tools enabling to reduce the negative impact of divorce on the under-age child. The term "shared parenting" has been introduced into our legal system since 1998. Shared parenting brings with itself several complex issues concerning children and their parents, the cooperation between them both from the emotional and material point of view. This diploma thesis deals with mediation, opinions of expert psychologists on shared parenting, determination of alimony in case of shared parenting, shared parenting in foreign countries and particularly with the court decision making and judge experience in issues concerning shared parenting.
