Abstract:

Tato diplomová práce se zabývá analýzou pohledávek a jejich vymáháním. V rámci úvodní kapitoly teoretické části je provedeno formální vymezení pojmu pohledávky od jejího vzniku, zajištění různými instrumenty, promlčení, až po její zánik. Další kapitola teoretické části je věnována možným způsobům uplatnění a vymáhání pohledávek, které jsou vymezeny současným platným legislativním rámcem. Praktická část diplomové práce je zaměřena na problematiku pohledávek vzniklých z nájemního vztahu mezi nájemci bytů a hlavním městem Prahou jako pronajímatelem. Za pomoci analýzy vzniku, řízení a vymáhání pohledávek, jsou identifikovány nedostatky ve způsobech vymáhání pohledávek. V závěru jsou navrženy postupy a doporučení ke zlepšení celého systému vymáhání pohledávek vzniklých z nájmu bytů hlavního města Prahy, které mohou vést k minimalizaci negativních dopadů existence daných pohledávek.

Abstract:

This thesis deals with the analysis of financial claims and their enforcement. Within the frame of the introductory theoretical chapter the concept of claim is formally qualified from its inception to expiration, including various securing instruments and questions of forfeiture. Next theoretical chapter address the questions of possible manners of implementation and enforcement of claims, which are defined by a valid current legislative framework. The practical part of this work focuses on claims arising from apartment-rental relationship between the leaseholders and the city of Prague as the landlord. By analyzing the origin, further management and debt collection the deficiencies in the ways of claim recovery are identified. Finally, the procedures and recommendations for improvement of system-wide recovery of claims arising from rental apartments owned by city of Prague are proposed. These can lead to minimize the negative impacts of existence of these claims.
