The Legal Protection of Intellectual Property in the Business Sector with "Body and Mind" Exercises

Abstract:

Tato bakalářská práce se věnuje právní ochraně duševního vlastnictví při podnikání v oblasti cvičebních stylů "body and mind". Cílem je ukázat a prověřit, zda lze a jak aplikovat ochranu práva duševního vlastnictví v oblasti podnikání s těmito cvičeními. Předmětem zkoumání je obchodní společnost Fitness Body Mind Educational Institute s. r. o. a její cvičební metody D-Yogi s využitím chráněných nehmotných statků. První část práce je zaměřena na nastínění právních a ekonomických aspektů zmiňované společnosti, na vysvětlení pojmů a problematiky podnikání v oboru „body and mind“. Další část práce věnuje pozornost jednotlivým oblastem práva duševního vlastnictví majícím souvislost s daným oborem podnikání. K tomuto je využito zejména metod výkladu práva, jazykové a systematické. Závěrečná část popisuje praktický příklad obchodování s duševním vlastnictvím zmiňované společnosti. Dále také rozebírá skutečný soudní spor týkající se duševního vlastnictví, jehož účastníkem byla zmiňovaná společnost. Výsledkem práce je zjištění, že ochrana práva duševního vlastnictví je aplikovatelná na podnikání v oboru „body and mind“, což je podloženo i skutečnou praxí podnikatelského subjektu.

Abstract:

This bachelor thesis deals with the legal protection of intellectual property in the business sector of exercise styles "body and mind". The aim is to show and verify whether and how the protection of intellectual property can be applied in the sector of business with these exercises. The subject examined is the company Fitness Body Mind Educational Institute Ltd. and its D-Yogi exercise methods with the use of protected intangible assets. The first part of the thesis is focused on outline concerning legal and economic aspects of the mentioned company and on explanation of business terms in the sector "body and mind". The next part pays attention to the concrete areas of intellectual property law related to the given business sector. For this purpose, mainly the methods of interpretation of law, linguistic and systematic, have been used. The final part describes a practical example of trading with intellectual property in connection with the company mentioned. It also analyses a real trial concerning intellectual property where the company was involved. The thesis results in finding that the legal protection of intellectual property is applicable to the business sector with "body and mind" exercises. This fact is also supported by the actual practice of the business entity mentioned.
