Abstract:

Diplomová práce je spojena s konceptem civilní mocnosti v souvislosti se Spolkovou republikou Německo. Cílem práce je zjistit, zda je možné označovat Německo konceptem civilní mocnosti i po roce 1994, kdy byl reinterpretován německý Základní zákon. V práci je analyzována zahraniční a bezpečnostní politika Německa nejdříve zahraniční a bezpečnostní politika Západního Německa, která byla označována konceptem civilní mocnosti, a dále zahraniční a bezpečnostní politika Německé spolkové republiky po jejím sjednocení v roce 1990. V 90. letech se začalo významně měnit mezinárodní prostřední a Německo bylo nuceno na tyto změny reagovat. Proto se od sjednocení obou německých států objevila potřeba reinterpretovat německou ústavu, a to v článcích, které zakazovaly účast Bundeswehru na akcích mimo území NATO. Tento zákaz byl odstraněn po mnoha debatách, a to Spolkovým ústavním soudem v roce 1994. Od té doby se němečtí vojáci Bundeswehru mohou účastnit operací mimo území NATO. V souvislosti s touto reinterpretací Základního zákona jsou analyzovány vojenské akce, kterých se Bundeswehr účastnil po roce 1994. Během celé práce jsou tak zkoumány principy charakterizující civilní mocnost, které definoval Hanns W. Maull. A následně je na základě těchto principů posuzováno, do jaké míry se Spolková republika Německo odklonila od konceptu civilní mocnosti po odstranění zákazu nasazovat německé vojenské jednotky mimo území NATO.

Abstract:

The master's thesis deals with the concept of Civilian Power in relationship with The Federal Republic of Germany. The goal of the thesis is to determine if Germany could be described as Civilian Power after 1994, the year the German Basic Law was reinterpreted. Foreign and safety policies of Germany are analysed in this thesis first the foreign and safety policies of former West Germany, which used to be defined as Civilian Power, and further the safety and foreign policies of The Federal Republic of Germany after its reunification in 1990. International environment changed significantly over 1990s and Germany was forced to react to these changes. Therefore the need to reinterpret German constitution emerged after the reunification of both German states, and especially the articles forbidding involvement of Bundeswehr in operations outside of NATO territory. This ban was cancelled after many discussions by The Federal Constitutional Court in 1994. Since then, German soldiers of Bundeswehr may be deployed outside the territory of NATO. With regards to reinterpretation of the Basic Law, military operations that Bundeswehr joined after 1994 are analysed here. Throughout the entire thesis, principles characterising Civilian Power, as defined by Hanns W. Maull, are investigated, and it is furthemore assesed to which extent has The Federal Republic of Germany diverted from the concept of Civilian Power after the ban of deploying German soldiers outside of NATO territory was annuled.
