Municipality as a VAT payer

Abstract:

Předmětem bakalářské práce „Obce v roli plátce DPH“ je popis a vysvětlení jednotlivých povinností, jenž má obec, je-li plátcem DPH. Jedná se především o vysvětlení pojmu veřejnoprávní subjekt a jeho obrat, stanovení zákonné registrace k plátcovství, vymezení předmětu daně a možnosti nároku na odpočet daně, v neposlední řadě představení způsobu vedení evidence pro daňové účely. Dále pak v praktické části práce blíže představit problematická ustanovení v praxi a nejčastější činnosti a případy, s nimiž se obec může setkat. Zejména nájem nemovitostí a služeb s tímto nájmem souvisejících, převod nemovitostí, prodej movitých věcí, likvidaci komunálního odpadu a kulturní činnost provozovanou obcí. Na závěr praktické části je analyzována efektivita se vznikem dobrovolné registrace obcí k plátcovství DPH.

Abstract:

The aim of my bachelor thesis “Municipality in the role of VAT-payer” is to address and explain the individual responsibilities of a municipality in the event of it being a VAT-payer. In principle, there are several terms to be explained such as a Public Entity and its turnover, as well as the statutory prerequisites for becoming a VAT payer, additionally specification of tax objectives and possible claims pertaining to tax deductions. And last, but not the least, the purpose herein is also to highlight the procedures concerning tax registration. Furthermore, the practical part lends close attention to introducing the problematic clauses in practice and the most frequent measures and scenarios that the municipality may come across in this context. This pertains, in particular, to leases and related services, conveyance of real estates, sale of personal (movable) property, municipality waste disposal and cultural activities run by the municipality. In the concluding section of the practical part there is an analysis on the effectiveness and formation of voluntary registration of municipalities for VAT reimbursements.
