Protection of Fundamental Rights and Freedoms in Criminal Proceeding

Abstract:

Bakalářská práce je zaměřena na ochranu základních práv a svobod v trestním řízení. Trestní řízení pojednává o postupu orgánů činných v trestním řízení, které je upraveno zákonem. V trestním řízení se rovněž nachází práva účastníků a dalších osob, která napomáhají spravedlivému procesu. Cílem bakalářské práce je analýza, která porovnává práva a povinnosti vybraných subjektů mezi sebou. Práce je rozdělena do dvou částí, z nichž první se zabývá teoretickými východisky, pro danou oblast. Po teoretické části následuje část praktická, která se zaměřuje na analýzu, ve které jsou porovnána práva konkrétních subjektů v trestním řízení mezi sebou. Jedná se o subjekty, kterými jsou, obviněný, poškozený a svědek.

Abstract:

The bachelor thesis is focused on the protection of fundamental rights and freedoms in criminal proceeding. Criminal proceedings deal with procedure of the authorities involved in criminal proceedings. Criminal proceedings include the rights of participants and other person facilitating a righteous process. The aim of the bachelor thesis is an analysis comparing the rights and obligations of selected entities. The paper is divided into two parts the first of which deals with the theoretical foundations of the field. The theoretical part is followed by a practical part focusing on the analysis in which the rights of specific entities in criminal proceedings are compared. These are subject such as the accused person, the aggrieved person and the witness.
