Legal Evaluation of the Treaty on Stability, Coordination and Governance in the Economic and Monetary Union - its Relationship to the EU Primary Law

Abstract:

Tato diplomová práce se zabývá právním hodnocením Smlouvy o stabilitě, koordinaci a správě v hospodářské a měnové unii a jejím vztahem k primárnímu právu Evropské unie. Smlouva má charakter mezinárodní smlouvy. Kvůli tomu jsou i ve Smlouvě zakotvena ustanovení, která by měla vylučovat její zasahování do práva EU, nicméně některé články Smlouvy tomu neodpovídají. Cílem práce je proto zhodnotit tento vztah s důrazem na působení problematických ustanovení Smlouvy na primární právo EU. Z tohoto důvodu je práce rozdělena do třech částí. V první je krátce nastíněna charakteristika primárního práva EU, druhá část se zabývá formální stránkou Smlouvy a poslední část se zaměřuje na obsahovou stránku Smlouvy s akcentem na zapojení institucí EU.

Abstract:

This thesis deals with The Treaty on Stability, Coordination and Governance in the Economic and Monetary Union and its relation with the primary law of EU. The Treaty has been created outside of the primary law. As a result of this situation there are provisions in the Treaty that should eliminate its interferences into to the primary law. Therefore, the aim of this thesis is to evaluate this relationship with the emphasis on the impact of some problematic articles of the Treaty on the primary law. Thesis is therefore divided into three parts. The first chapter describes the characteristic of the primary law of EU. The second chapter deals with the formal aspect of the Treaty and the third chapter focuses on the content part of the Treaty with an emphasis on the involvement of the institutions of EU.
