The New Hungarian Media Law: A Threat to Free and Independent Media?

Abstract:

This thesis deals with the media law in Hungary and it analyzes its problematic issues. While the media law refers to relations between state and media, we examine the influence of political process on the media regulation in the context of media theories. The thesis consists of theoretical and empirical part. In theoretical chapters, we deal with conditions determining democratic system, we analyse the concept of freedom of speech and the approach to the alternative sources of information. Then we introduce how media should work in accordance with the particular media theories. In the empirical part, we describe the Hungarian media system since the regime shift until today with particular emphasis on the policies related to freedom and independency of media. Afterwards we devote some space to the development of media law and the conditions of its origin. Then we focus on analysis of particular issues of legal regulation, which are considered from the viewpoint of theories illustrated in the first part of the thesis. In conclusion, we summarize the main lessons emerging from the thesis.

Abstract:

Práca sa zaoberá maďarským mediálnym zákonom a je analýzou problematických bodov v zákone. Keďže mediálny zákon sa týka najmä vzťahu medzi štátom a médiami, skúmame vplyv politiky na mieru regulácie činnosti médií v kontexte mediálnych teórií. Práca sa skladá z teoretickej a empirickej časti. V teoretickej časti sa zaoberáme podmienkam, ktoré určujú demokratický systém, bližšie rozoberáme koncept slobody prejavu a prístupu k alternatívnym informáciám. V súvislosti s tým predstavujeme ako by média mali fungovať podľa jednotlivých normatívnych teórií. V empirickej časti popisujeme maďarský mediálny systém po zmene režimu až po súčasnosť so zreteľom na vzťah politiky k slobode a nezávislosti médií. Následne sa venujeme vývoju samotného mediálneho zákona a podmienkam jeho vzniku. V ďalšej časti sú predmetom analýzy jednotlivé body právnej regulácie, ktoré vzťahujeme k načrtnutým teóriám v prvej časti práce. Záverom zhŕňame hlavné poznatky vyplývajúce z práce.
