Reflection of Comitology revision from the perspective of the European Parliament

Abstract:

Předkládaná diplomová práce se bude zabývat postojem Evropského parlamentu k reformám Komitologie. Komitologie představuje v rámci EU kontrolní mechanismus, jehož prostřednictvím členské státy kontrolovaly Komisi při výkonu delegovaných pravomocí. Evropský parlament se stal hlavním kritikem kontrolního mechanismu, jelikož byl dlouhou dobu ze systému výborů vyloučen. Vadilo mu, že jako jediný přímo volený orgán a jako jeden z legislátorů nemá právo podílet se na kontrole delegovaných pravomocí. Základem práce proto bude analýza jeho požadavků k fungování komitologie s ohledem na jeho celkové postavení v institucionálním systému EU. Jednotlivé ambice Evropského parlamentu budou zkoumány od vzniku tohoto systému výborů s ohledem na směřování EU k Lisabonské smlouvě. Cílem práce bude odpovědět na otázku, zda výsledná reforma komitologie provedená v Lisabonské smlouvě skutečně odráží veškeré požadavky Evropského parlamentu. Práce bude zasazena do teoretického rámce vycházejícího z teorie racionální volby, který nám pomůže objasnit kroky Evropského parlamentu, které podnikl za účelem změny pravidel komitologie.

Abstract:

This master thesis deals with the position of the European Parliament to the revisions of the Comitology. Comitology represents a control mechanisms designed by member states of EU, which primary task was to supervise executive activities of the European Commission. The European Parliament strongly opposed Comitology committees, because it was not involved in this supervision. The European Parliament as a directly elected body doesn´t have right to control executive activities. The main purpose of this thesis will be the analysis of the parliamentary requirements for the parliament´s involvement in the Comitology. Individual ambition will be examined from the creation of the first Comitology committees with regard to Lisbon treaty. In the context of Lisbon treaty we will clarify if the last revision of Comitology system reflects the whole European Parliament position. We will examine this relation in the theoretical framework of rational choice theory.
