Acknowledgement of a Debt in Case Law and Practice

Abstract:

Diplomová práce se zabývá vybranými problémy, které se v souvislosti s užíváním institutu uznání dluhu v praxi objevují. První kapitola obsahuje vymezení uznání dluhu v německém právním řádu, ve zbývajících kapitolách je pak pojednáno o jednotlivých okruzích pro praxi významných otázek, jako je např. možnost stran ujednat si vlastní způsob uznání dluhu nebo otázka účinků uznání. Práce nabízí vlastní argumenty, jež spolu s odkazy na německou právní úpravu a tuzemskou judikaturu tvoří základ předkládaných řešení pro zkoumané problémy.

Abstract:

The diploma thesis deals with selected problems that occur in connection with a usage of the acknowledgement of a debt in practice. The first chapter includes a definition of the acknowledgement of a debt in German jurisprudence, the re-maining chapters deal with particular questions important for the practice, such as possibility of parties to arrange their own method of the acknowledgement or the question of acknowledgement’s effects. The thesis offers its own arguments, which together with the references to German legislation and domestic case law form a basis of presented solutions to the examined problems.
