International Courts and democracy: Impact of European Court for Human Rights on democratization in Serbia after 2003

Abstract:

This thesis deals with the impact of the international courts on the political processes within the states and particularly it focuses on the impact of ECtHR on the process of democratization in the Serbian political system after 2003. The main purpose of the work is not to analyse judgements of ECtHR, rather it deals with their execution and their impact on the shift of Serbia to democracy, main characteristics of which are described in the introduction of the work. These include free regular elections, a possibility of political participation, protection of political rights, etc. The main goal of the thesis is to answer the question of the position of ECtHR in the process of Serbian democratization. Whether it is beneficial for the process, or, on the contrary, disadvantageous, and whether are its decisions respected by the other states.

Abstract:

Tématem práce je problematika působení mezinárodních soudů na politické procesy vně států, konkrétně se zde předložená bakalářská práce bude věnovat vlivu ESLP na proces demokratizace politického systému Srbska po roce 2003. Práce nemá za cíl rozbor jednotlivých rozsudků ESLP, ale bude se snažit sledovat jejich implementaci a ohodnocení jejich významu pro posun k demokracii, jejíž základní znaky budou identifikované v úvodu práce, půjde hlavně o pravidelné svobodné volby, všeobecnou možnost politické participace, ochranu politických práv atd. Hlavním cílem práce bude zodpovědět otázku, jaká je pozice ESLP v procesu demokratizace. Zda dokáže proces urychlovat anebo ho brzdit, zda je přínosný nebo kontraproduktivní a či jsou jeho rozhodnutí státy respektované.
