Legislative instruments of cooperation to secure local public order matters

Abstract:

Bakalářská práce je zaměřena na využití legislativních nástrojů k zajištění místních záležitostí veřejného pořádku obcí s využitím veřejnoprávních smluv a koordinačních dohod. Teoretická část jmenuje základní pojmy k tématu a právní úpravu uvedených legislativních nástrojů a analyzuje hlavní subjekty a jejich možnosti. Praktická část je rozdělena na dvě části. První zjišťuje využití veřejnoprávních smluv a koordinačních dohod v celostátním měřítku, druhá část popisuje jejich využití ve vybraném regionu a následně u každé části identifikuje jejich pozitiva a negativa. Součástí práce je identifikování překážek a nalezení příčin současného nevyhovujícího stavu v uzavírání koordinačních dohod a veřejnoprávních smluv. Závěrem je problematika zajišťování místních záležitostí veřejného pořádku na území obce zobecněna, jsou vyhodnoceny získané poznatky s návrhy na odstranění problémových částí a nedostatků a jsou formulována doporučení pro praxi.

Abstract:

The thesis is focused on the usage of legislative instruments to deal with securing local public order matters of municipalities using public contracts and coordination agreements. Theoretical part names basic terms connected with the topic and legislation of the listed legislative instruments and analyzes main subjects and their possibilities. Practical part is divided into two parts. The first finds out the utilization of public contracts and coordination agreements on the national scale, the second part describes their utilization in the chosen region and further identifies at every part its positives and negatives. Part of the thesis is identifying obstacles and finding causes of the current unsatisfactory state of concluding coordination agreements and public contracts. In the conclusion is the problematic of finding out local public order matters in the area of the municipality generalized, the gathered findings with suggestions of problematic parts removal and shortcomings are evaluated and the recommendations for practice are formulated.
