Unfair plotting in public procurement and public sale

Abstract:

The aim of this Bachelor thesis is to highlight the issue of machinations in public procurement and public auction. In this work, I will be given to the definition of the term public contracts, its characteristics, the need for, a basic principle, and public procurement after the incorporation into the European Union and to the reforms. I skip to definition of the term public auction and the progress of the public auction. Given that the contrivance in public procurement and public auction shall fall within the economic crime, economic crime and analysis development of its species. Further explanation of what is the crime of deceit, in public procurement and public auction, joining procurement and auctions for corruption, but also the impact of corruption in public procurement for societal values, as well as the business environment. In the work there are also few specific cases of machinations in public procurement and the penalties which the Court deems this offence imposes.

Abstract:

Cieľom tejto bakalárskej práce je poukázať na problematiku machinácii pri verejnom obstarávaní a verejnej dražbe. V tejto práci sa budem venovať vymedzeniu pojmu verejné obstarávanie, jeho charakteristike, potrebe, základným princípom, verejnému obstarávaniu po začlenení do Európskej únie a jeho reformám. Prejdem k vymedzeniu pojmu verejná dražba a priebeh verejnej dražby. Vzhľadom na to, že machinácie pri verejnom obstarávaní a verejnej dražbe spadajú do hospodárskej kriminality, rozoberiem vývoj hospodárskej kriminality a jej druhy. Ďalej vysvetlenie aký trestný čin machinácie pri verejnom obstarávaní a verejnej dražbe sú, naviazanosť verejného obstarávania a dražby na korupciu, ale aj dopad korupcie pri verejnom obstarávaní na spoločenské hodnoty ako aj podnikateľské prostredie. V práci uvediem aj konkrétne prípady machinácii pri verejnom obstarávaní a sankcie, ktoré súd za tento trestný čin ukladá.
