Hrdelní tresty uložené mimořádnými lidovými soudy v Plzni a Klatovech v letech 1945 až 1947

Abstract:

Práce je sondou do československého retribučního soudnictví, konkrétně do činnosti mimořádných lidových soudů v Plzni a v Klatovech v letech 1945 až 1947. Analýza spisů 60 hrdelních trestů, které tyto soudy v tomto zákonem stanoveném období vynesly, poskytuje obraz značně specifické součásti systému československého poválečného práva z historického pohledu. Základem práce je neobyčejně rozsáhlý archivní materiál SOA v Plzni, z něhož jsou vzhledem k omezenému rozsahu kvalifikační práce zpracována jen nejdůležitější fakta. Ukázalo se, že spisy nejtěžších trestů, za které je nutné tresty smrti považovat, dávají sice různorodý, ale přesto poměrně reprezentativní obraz činnosti obou zkoumaných soudů. Velký retribuční dekret, který byl základní normou pro činnost MLS v období 1945 - 1947, byl soudy uveden do praxe ve velmi specifickém historickém období přechodu od jedné totality ke druhé. Proto lze největší část uložených hrdelních trestů považovat za adekvátní pokus o vyrovnání se s minulostí v rámci tehdejšího komplikovaného poválečného období, které je obdobím nesrovnatelným s obdobím rozvinutých demokratických svobod. Přesto jsou v práci popsány i některé nedostatky v praktické činnosti zkoumaných soudů, konkrétně několik případů hrdelních trestů, uložených příliš tvrdě, a naopak přílišná shovívavost, též realizovaná v několika málo případech. Porovnáním s dostupnou odbornou literaturou je možné konstatovat, že činnost obou soudů nevybočuje z tehdejší situace v poválečném Československu s tím, že oba soudy patřily v rámci 25 MLS spíše k těm přísnějším, nikoli však k nejpřísnějším. Autor se bádáním v průběhu čtyř let přesvědčil, že archivní materiál k této problematice je natolik rozsáhlý, že skýtá velmi široký základ pro další širší a hlubší výzkum a podle většího počtu citovaných prací je tomu tak i u dalších MLS. Zejména otázka vyrovnání se s minulostí a porovnání mezi MLS retribučního soudnictví a československými a českými soudy pozdějších období, která v průběhu psaní práce a v jejích závěrech spontánně vystupovala do popředí, může být námětem pro zaměření dalšího bádání.

Abstract:

The thesis is a survey of the Czechoslovak retribution judiciary, specifically of the activities of extraordinary people's courts in Plzeň and Klatovy in the years 1945 to 1947. The analysis of the files of 60 capital punishments, which these courts passed in this period stipulated by law, provides a picture of a very specific part of the system of the Czechoslovak post-war law from the historical point of view. The basis of the work is an unusually extensive archival material of the State Regional Archive in Plzeň, from which, due to the limited scope of the qualification work, only the most important facts are processed. It turned out that the files of the most severe punishments, and the death penalties must be considered as such, give a diverse, but nevertheless relatively representative picture of the activities of both examined courts. The Great Retribution Decree, which was the basic standard for the activities of the MLS (local people's courts) in the period 1945-1947, was put into practice by the courts in a very specific historical period of transition from one totalitarian system to another. Therefore, most of the imposed capital punishments can be considered an adequate attempt to come to terms with the past within the then complicated post-war period, which is a period incomparable with the period of developed democratic freedoms. Nevertheless, the work also describes some shortcomings in the practical activities of the examined courts, namely several cases of capital punishments, imposed too harshly, and, conversely, excessive leniency, also realized in a few cases. By comparison with the available specialised literature, it is possible to state that the activity of both courts does not deviate from the then situation in post-war Czechoslovakia, with both courts belonging to the stricter, but not the strictest within the 25 MLS (local people's courts). Through research over the course of four years, the author became convinced that the archival material on this issue is so extensive that it provides a very broad basis for further broader and deeper research, and according to a larger number of cited works, this is also the case for other MLS. In particular, the question of coming to terms with the past and comparing between the MLS of retributive judiciary and the Czechoslovak and Czech courts of later periods, which spontaneously came to the fore during the writing of the thesis and its conclusions, may be a topic for further research aiming.
