The Czech Republic and the Infringement Proceedings under Article 258 TFEU

Abstract:

Předmětem bakalářské práce je popsání prosazování práva Evropské unie vůči členským státům se zaměřením na situaci v České republice. Nejdříve se zaměřuji na vynucování práva Evropské unie a rozebírám jednotlivé kroky řízení pro porušení povinnosti na základě článků 258 a 260 SFEU. V další části práce analyzuji vývoj a aktuální situaci ČR v rámci řízení pro porušení povinnosti od doby vstupu do Evropské unie. Závěrem práce je zjištění, že v porovnání se všemi 27 členskými státy EU je Česká republika za rok 2011 dvanáctým nejčastějším účastníkem v řízení pro porušení povinnosti. V rámci řízení před Evropským soudním dvorem v období 2004-2013 jsem porovnala 10 států, které vstoupily do EU v roce 2004, a Česká republika se řadila po Polsku mezi státy s největším počtem žalob.

Abstract:

The subject of this thesis is to describe the European Union′s law enforcement against Member States with focus on the situation in the Czech Republic. First, I focus on the European Union′s law enforcement and I analyze particular steps of the infringement procedure under Articles 258 and 260 TFEU. The next section analyzes the development and current situation of the Czech Republic in the framework of infringement proceedings since joining the European Union. The conclusion of this thesis is finding that compared with all 27 EU Member States, the Czech Republic was in 2011 the twelfth most frequent participant in the infringement procedure. In proceedings before the European Court of Justice in the period 2004-2013 compared to the 10 countries that joined the EU in 2004 was Czech Republic ranked among the states with the largest number of lawsuits.
