Judicial and alternative dispute resolution in matters of the child custody

Abstract:

Diplomová práce zohledňuje ve svém obsahu soudní řízení, při kterém soud rozhoduje o svěření nezletilých v souvislosti s rozvratem a následným rozvodem manželství rodičů. Zabývá se tedy úpravou poměrů rodičů k dítěti vždy v době po rozvodu manželství či příležitostně po rozchodu partnerů, brání-li jim nějaké nevyřešené překážky v uzavření dohody ohledně péče o dítě. De lege lata je prostor v práci věnovaný hmotněprávní úpravě s rozlišením jednotlivých forem péče, s nimi související úprava styku, stanovení vyživovací povinnosti, na kterou navazuje a s níž je propojena část týkající se samotného procesního řízení či jeho úpravě v péči o nezletilé včetně jeho specifik, která jsem se snažila v práci více přiblížit. Nedílnou součástí práce je i možnost případného mimosoudního řešení sporu. Následně je věnována pozornost roli advokáta, mediátora a opatrovníka. V závěru práce poukazuji na možné nedostatky právní úpravy a uvádím praktické příklady problémů, které vznikají v souvislosti s rozvodem či rozchodem obecně i v souvislosti s právní úpravou.

Abstract:

The thesis takes into account in its content the court proceedings in which the court decides on the custody of minors in connection with the breakdown and subsequent divorce of the parents' marriage. It therefore deals with the adjustment of the parents' relationship to the child always in the period after the dissolution of the marriage or occasionally after the separation of the partners, if any unresolved obstacles prevent them from concluding an agreement on child custody. De lege lata is the space in the thesis devoted to the substantive regulation with the distinction between the various forms of custody, the related regulation of access, the determination of maintenance obligations, which is followed and connected to the part concerning the procedural procedure itself or its regulation in the care of minors, including its specifics, which I have tried to bring more closely in the thesis. An integral part of the work is also the possibility of possible out-of-court dispute resolution. Subsequently, attention is paid to the role of the lawyer, mediator and guardian. In the conclusion of the thesis I point out possible shortcomings of the legal regulation and give practical examples of problems that arise in connection with divorce or separation in general and in connection with the legal regulation.
