Law as a Component of Postmodern Thought

Abstract:

Předložená práce se soustředí na rozbor některých postmoderních koncepcí a jejich aplikaci v oblasti práva. Hlavní pozornost je věnována filosofii Jeana Françoise Lyotarda (zejména jeho úvahám o velkých vyprávěních, jejich vztahu k modernitě a procesu delegitimizace), jejíž principy jsou používány k osvětlení zásadních otázek z oblasti lidských práv, v první řadě jejich legitimity. Autor podrobně vymezuje pojem velkého vyprávění a způsobu, jakým působí v oblasti lidských práv. Dále se zabývá pojmem a příčinami delegitimizace a možnými reakcemi na tento proces. Velká část práce je rovněž věnována vztahům mezi univerzalismem, legitimitou a lidskými právy. Na závěr se autor pokouší o korekci tradičních otázek po legitimitě lidských práv a sumarizuje další možné postmodernou ovlivněné přístupy k lidskoprávní problematice.

Abstract:

The submitted thesis is focused on an analysis of some postmodernist conceptions and their use in a branch of law. The main attention is dedicated to philosophy of Jean François Lyotard (especially his reflections of metanarratives, their relation to modernity and delegitimisation), whose principles are used to clarify fundamental questions of human rights, foremost their legitimacy. In this work, the author defines the concept of metanarrative and its effect on human rights. He also researches the concept and causes of delegitimisation and possible reactions to it. Large part of work is dedicated to relations between universalism, legitimacy and human rights. At the end of the work the author tries to correct some traditional questions about legitimacy of human rights and summarizes another postmodernist approaches to human right's issues.
