Financial Markets Integration of Regulation and Supervision Theoretical Basis and its Feasible Implementation

Abstract:

Důvěra klientů je základním stavebním kamenem dobře fungujícího a transparentního finančního trhu. Důvěru posiluje snaha o dosažení co nejoptimálnější míry regulace a dohledu nad finančním trhem. V rámci této snahy dochází k větší mezinárodní spolupráci a integraci regulace a dohledu. Integrace má své klady, ale také svá úskalí. Není možné najít pouze jeden model fungující a efektivní regulace a dohledu, který by vyhovoval všem státům. Česká republika se rozhodla pro integraci dohledových orgánů do centrální banky. Také přistoupila ke společnému tržnímu a regulatornímu režimu, který je platný pro všechny členské státy Evropské unie, a který se jistě bude v budoucnu dále rozšiřovat. Ve své práci jsem hodnotila především tuto integraci regulace a dohledu, která v České republice proběhla, a dotkla jsem se i procesů, které byly odstartovány na úrovni Evropské unie. Došla jsem k závěru, že zvolené řešení bylo správné a pozitivně působí na fungování českého finančního trhu, a dále k tomu, že trendy zahájené na úrovni Evropské unie jsou objektivním (i když s určitými problémy) vyjádřením integrace národních trhů v jednotný evropský trh.

Abstract:

Confidence of clients is the fundamental prerequisite for a transparent and properly functioning financial market. This confidence is enhanced by an effort to reach the most optimal degree of financial markets regulation and supervision. Within the scope of this effort, more intensive international cooperation and integration of regulation and supervision are taking place. The integration has its pros and cons. It is not possible to find out just one model of an efficient and effective regulation that would be suitable for all countries. The Czech Republic has decided for an integration of supervision authorities under the central bank. It has also acceded to the common market and regulatory regime, which is valid for all EU member states, and which is set to widen in the future. I evaluate, above all, this integration of regulation and supervision implemented in the Czech Republic in this work, and I also outline the processes that have been launched at the EU level. I have come to the conclusion that the selected method was correct as it is positively influencing the operation of the Czech financial market, and that the trends initiated at the EU level are an objective (though with certain problems) reflection of integration of national markets into the single European market.
