Sharp object injuries in violent crimes and the mechanism of their occurrence

Abstract:

Předkládaná práce se zabývá tématem poranění ostrým předmětem u násilných trestných činů a mechanismem jejich vzniku. Práce je rozdělena do několika samostatných kapitol doplněných souvisejícími přílohami. Stěžejní obsah práce je zaměřen na typologii poranění ostrým předmětem a mechanismem vzniku jednotlivých typů poranění. Zvláštní význam je zde přikládán charakteristikám jednotlivých typů těchto zranění a jejich výskytu při nešťastných náhodách, sebevraždách či sebepoškozování a při páchání trestných činů násilného charakteru. Samostatná kapitola je pak věnována i jednotlivým nejčastěji se vyskytujícím trestným činům, u kterých se můžeme s těmito zraněními setkat. Samostatná kapitola je pak věnována i posuzování těchto poranění na těle oběti a zjišťování příčin smrti. V této souvislosti je pak věnována pozornost prohlídce těla živé osoby, ohledání těla zemřelého na místě činu a pitvě zemřelého. Výklad je dále zaměřen i na základní vymezení problematiky krevních stop, vznikajících při poranění ostrým předmětem. V této souvislosti je proveden stručný nástin problematiky formování krevních stop a jejich analýzy. Jsou představeny jednotlivé typologie krevních stopy a jednotlivé jejich typy. Samostatná pasáž je pak věnována výkladu krevních stříkanců způsobených ostrým předmětem. V práci je dále vymezena základní charakteristika soudního lékařství a jeho úloha při vyšetřování trestných činů. V této souvislosti je pak proveden výklad o právní úpravě soudně lékařské znalecké činnosti a úloze soudního lékaře v trestním právu při vyšetřování násilné trestné činnosti. Jsou vymezeny základní charakteristiky lékařské zprávy, jako důkazu v trestním řízení, konzultační činnosti lékaře, odborných vyjádření a problematiky znaleckých posudků z odvětví soudního lékařství.

Abstract:

This thesis deals with the topic of sharp injuries in violent crimes and the mechanism of their occurrence. The thesis is divided into several separate chapters supplemented by related appendices. The main content of the thesis is focused on the typology of sharp injuries and the mechanism of occurrence of each type of injury. Particular importance is attached to the characteristics of the different types of these injuries and their occurrence in accidents, suicides or self-harm and in the commission of violent crimes. A separate chapter is then devoted to the individual most common crimes in which these injuries may be encountered. A separate chapter is then devoted to the assessment of these injuries on the victim's body and the determination of the cause of death. In this context, attention is then given to the examination of the body of a living person, the examination of the body of the deceased at the scene of the crime and the autopsy of the deceased. The interpretation is also focused on the basic definition of the issue of blood traces arising from injuries caused by a sharp object. In this context, a brief outline of the formation of blood traces and their analysis is given. Individual typologies of blood traces and their types are presented. A separate passage is then devoted to the interpretation of blood spatter caused by a sharp object. The basic characteristics of forensic medicine and its role in criminal investigations are further defined. In this context, an interpretation is then made of the legal regulation of forensic expert activity and the role of the forensic doctor in criminal law in the investigation of violent crime. The basic characteristics of the medical report as evidence in criminal proceedings, the consulting activity of the doctor, expert opinions and the problems of expert opinions in the field of forensic medicine are defined.
