The Labour Relationship between the Year 1945-1965

Abstract:

Disertační práce pojednává o pracovním poměru v letech 1945 až 1965 na území nynější České republiky, zaměřuje se na jeho charakteristické znaky a obsahové náležitosti a tyto předkládá se zasazením do dějinných souvislostí a obecného právního vývoje tak, aby byl zachycen nejen stav soudobé právní úpravy, ale i širší kontext. Náležitá pozornost je však věnována také orgánům veřejné moci, mocensky působících při usměrňování pohybu pracovních sil, stejně jako jednotlivým prostředkům, jež napomohly realizaci národní mobilizace pracovních sil. Pracovní poměr vznikal a zanikal právě v rámci stanovených direktiv, smluvní svoboda byla do velké míry omezena, což se promítlo nejen co do otázky uzavírání a rozvazování pracovního poměru, ale též do pojetí a rozsahu okruhu subjektů pracovněprávního vztahu, odměny za práci, pracovní doby, otázek bezpečnosti práce, zastupování zaměstnanců v odborových organizacích a řešení pracovněprávních sporů. Zvláštní pozornost je přitom věnována zvláštním druhům pracovních poměrů.

Abstract:

The dissertation thesis addresses the topic of employment between 1945 and 1965 on the territory of the current Czech Republic, focuses on its characteristic features and content elements, and presents them situated within the historical continuity and the general evolution of law in order to capture both the condition of current legislation and the broader context of the matter. Moreover, the thesis carefully looks into the role of public authorities, applying their position of power for the purposes of directing the movement of workforce, as well as into individual measures which were of assistance during the realization of the national mobilization of workforce. The employment was established and ceased to exist on the basis of directives which were officially laid down, for the contractual freedom was significantly limited, which influenced not only the matters of entering into employment and terminating it, but also the concept and extent of the range of subjects to the employment, remuneration for work, working hours, the topic of safety at work, representation of employees in the form of labour unions and the resolution of work-related disputes. Furthermore, a special attention is paid to extraordinary types of employment.
