"Correction" of the Material Concept of Decision according to the Code of Administrative Justice

Abstract:

Práce se věnuje „korekci“ materiálního pojetí rozhodnutí správního orgánu ve smyslu soudního řádu správního. Judikatura správních soudů, zejména rozšířeného senátu Nejvyššího správního soudu, v posledních letech naznačuje potřebu jisté korekce extenzivního pojetí pojmu „rozhodnutí“. K ní dochází prostřednictvím formálních znaků dovozovaných soudními rozhodnutími. Cílem práce je pomocí analýzy vybraných rozhodnutí zhodnotit, do jaké míry korekce v judikatuře probíhá, a nakolik představuje vhodné řešení. Závěrem práce jsou nastíněny možné legislativní změny.

Abstract:

The thesis addresses the “correction” of the material concept of administrative decision according to the Code of Administrative Justice. The case law of administrative courts, in particular the Supreme Administrative Court and its extended chamber, suggests the need of correcting the extensive interpretation of the term “decision”. The correction occurs on the basis of formal criteria resulting from the case law. The aim of this thesis is to evaluate whether the correction is present and ongoing in the case law, and whether it represents a suitable solution. Finally, the thesis proposes possible legislative changes.
