Claims Recovery

Abstract:

Tato diplomová práce pojednává o způsobech vymáhání pohledávek s přihlédnutím k nákladovosti a efektivitě zvoleného řešení. Pojednávané téma je aktuální a to i z pohledu blížící se účinnosti nového občanského zákoníku. Autor srovnává současnou a budoucí právní úpravu, jak již bylo uvedeno, v ekonomickém kontextu dopadů do nákladů firem, tedy při respektování kritérií řádného hospodáře. Cílem této diplomové práce je analyzovat metodiku vymáhání pohledávek v podmínkách konkrétních podnikatelů s důrazem na efektivnost zvolených postupů v kontextu optimalizace vynaložených nákladů věřitelem. V teoretické části se autor zabývá platnou, a především účinnou právní úpravou, zajišťovacími prostředky a způsoby vymáhání pohledávek, jak jsou upraveny v legislativní rovině. Dále tato část práce komentuje smluvní problematiku a možné strategie vymáhání. Teoretická část přechází k praktické srovnávací tabulkou. Kritérium volby zvolené strategie, sledující hospodárnost, je takto spolehlivě osvědčeno. V praktické části autor porovnává náklady na jednotlivé metody v konkrétních firmách. Poukazuje na výhody a nevýhody zvolené strategie a metody pro vymáhání pohledávek daných firem.

Abstract:

This diploma thesis deals with methods of claims recovery having regard to cost and effectiveness of the selected solution. The discussed topic is opportune even from the point of view of the new Civil Code approaching coming into effect. The author compares current and future legislation, as previously mentioned, in context of economic impact on expenses of companies, when the due diligence criteria is respected. The objective of this thesis is to analyze the methodology of claims recovery in conditions of specific businesses, with an emphasis on the effectiveness of the selected procedures in the context of optimization of costs incurred by creditor. In the theoretical part, the author discusses current and most of all legislation in effect, hedging means and methods of recovery, as defined on the legislative level. Furthermore, this part of the work comments on contractual issues and possible recovery strategies. The theoretical part is transferred to the practical comparative table. The criterion of the selection of the chosen strategy by monitoring efficiency is thus reliably attested. In the practical part, the author compares the costs of different methods in specific companies. He points out the advantages and disadvantages of the given companies regarding claims recovery.
