Human Rights in the European Union after the Treaty of Lisbon

Abstract:

Tato bakalářská práce mapuje současný vývoj v oblasti ochrany lidských práv v Evropské unii a hodnotí přínos reforem, které v této oblasti zavádí nová reformní smlouva. Lisabonská smlouva činí dvě podstatné změny v souvislosti se základními právy. První změnou je, že Charta základních práv EU se stává právně závazným dokumentem, druhou pak, že Unii je umožněno přistoupit k Evropské úmluvě o ochraně lidských práv a základních svobod. Ačkoliv se tyto reformy samy o sobě zdají být pro oblast ochrany základních práv v EU přínosem, otvírají řadu problematických otázek, se kterými se bude muset Evropská unie vypořádat, pokud chce pro své občany zajistit fungující systém ochrany lidských práv.

Abstract:

This bachelor thesis deals with the current development in the area of human rights protection in the European Union and evaluates contribution of the reforms which are going to be introduced by the new amending treaty in this area. The Treaty of Lisbon makes two significant changes in relation to fundamental rigths. The first is that the Charter of Fundamental Rights of the EU becomes legally binding. The second is that the Treaty commits the Union to accession to the European Convention on Protection of Human Rights and Fundamental Freedoms. Although these reforms seem to be beneficial for the area of fundamental rights protection in the EU, they bring a lot of problematic questions, which the European Union has to deal with if wants to secure for its cititizens workable system of human rights protection.
