The Institute of Lapse - Present Legal Regulation in the Civil Code in Comparison with the Previous Legal Regulation and the Austrian Civil Code

Abstract:

Tato diplomová práce se věnuje institutu promlčení podle zákona č. 89/2012 Sb. a hodnotí ji ve vztahu k původní úpravě v zákoně 40/1964 Sb. a k rakouskému Obecnému zákoníku občanskému č. 946/1811 Sb. Práce je rozdělena do pěti částí, kde první část pojednává o historickém vývoji promlčení v českém a rakouském právu, další se zaměřuje na odlišení promlčení od jiných forem uplynutí času v občanském právu, třetí a čtvrtá kapitola se týká vlastní komparace. V závěrečné části práce navrhuje vhodnější úpravu u problematických oblastí. Cílem práce je vyhledat rozdíly mezi právními úpravami a poukázat na problémy, které i přes novou úpravu mohou v praxi přetrvávat a analyzovat současnou rakouskou právní úpravu, která v minulosti po dlouhou dobu určovala právní stav v Českých zemích.

Abstract:

The thesis focuses on the Institute of Lapse under the Act no. 89/2012 Coll. and evaluates it in relation to the original regulation in Act no. 40/1964 Coll. and to the Austrian Civil Code no. 946/1811 Coll. Thesis is divided into five sections whereas the first section deals with the historical development of the Institute of Lapse in the Czech and Austrian law, the next focuses on the differentiation the Lapse from the other forms of expiration of time in the Civil law, the third and fourth chapter relate comparison itself. Thesis in the final section suggests preferable regulation for the problematic areas. The aim of the Thesis is to search out differences between the legislations; to highlight the issues which may persist in practice despite of the new regulation and to analyse the current Austrian legislation which in the past for a long time determined the legal situation in the Czech lands.
