Surrogate Mother as a Legal Problem? Philosophical and Legal Analysis

Abstract:

The thesis deals with the issue of surrogate motherhood regarding the philosophic-juridical aspect. It analyzes the surrogate motherhood on the basis of the position of women within society from the point of view of technological development of assisted reproduction, ethics and jural control of this institute in Czech republic and other chosen countries. The aim of the thesis is to demonstrate the new dimension of family relationships in context to the surrogate motherhood and its projection to the arising jural relationships. By means of the discourse there are searched answers for questions in the thesis whether the surrogate motherhood is acceptable from the point of view of ethics and whether its legal control in Czech republic is necessary. In this context there are presented certain solutions of de lege ferenda.

Abstract:

Tato práce se zabývá náhradním mateřstvím z filosoficko-právního pohledu. Zkoumá náhradní mateřství na pozadí postavení žen ve společnosti, z hlediska technického pokroku asistované reprodukce, z pohledu morálky a právní regulace tohoto institutu v České republice a v dalších vybraných státech. Cílem práce je ukázat novou dimenzi rodinných vztahů v souvislosti s náhradním mateřstvím a její promítnutí do vznikajících právních vztahů. Prostřednictvím diskurzu se v práci hledají odpovědi na otázky, zda je náhradní mateřství přípustné z morálního hlediska a zda je v České republice potřebná jeho zákonná regulace. V této souvislosti jsou načrtnuta možná řešení de lege ferenda.
