The free movement of services and the Directive on services in the Internal Market

Abstract:

Služby jsou budoucností Evropy. Moderní svět vyžaduje služby vysoké kvality, služby náročné na inovace a know-how, přičemž Evropská unie byla vždy v těchto oblastech vysoce konkurenceschopná. V poslední době se ovšem zdá, že s bouřlivým rozvojem zemí třetího světa Evropa tento náskok ztrácí. Tato skutečnost vedla Evropskou Komisi v roce 2004 k představení návrhu směrnice. Tento právní instrument, jeho charakteristika a dopady, stejně tak jako služby jiných sektorů, jsou tématem mé bakalářské práce. Koncepčně se práce rozpadá do čtyřech hlavních částí. Jejím hlavním tématem jesměrnice o službách a kritický přístup k tomu, co bude pro vnitřní trh její implementace znamenat. Druhým tématem práce jsou služby v sektorovém pojetí – tedy ty služby, které nespadají do rozsahu směrnice o službách. Třetí část práce se soustředí na aktuální téma služeb obecného zájmu. Konečně se pak práce ve své čtvrté části zabývá zhodnocením možné budoucnosti služeb na vnitřním trhu jako takových.

Abstract:

Services are the future of Europe. Modern world demands high-tech services and European providers have always had the edge as to the quality and complexity of the services they provided. However, in recent years, one cannot ignore that there has been a certain fallback in the amount of a European international trade in services. This, followed by other reasons, led the European Commission to present the draft of the new Services Directive. This legal instrument, its impact and its characteristics as well as other areas of services sector and their proper problems are the theme of my thesis. As noted above I have tried to take a deeper look into the services sector in general. That’s why my thesis breaks into four different parts. The central theme is the services directive itself and the critical approach to its benefits. The next topic of my thesis is the services that had been excluded from the scope of the services directive (health services, postal services and financial services). I have analyzed these three sectors in order to provide the reader with information on three differing sectors of services which provide some sort of model for all the other sectors of services. The third part of my thesis is dedicated to the issue of services in general economic and non economic interest which as a theme still gains on importance. The last but not least part of the thesis deals with my ideas on the possible future of the internal market of services.I have constructed a hypothesis as a central pillar of my thesis: will the services directive have a profound impact on the internal market of services? I presume that “no” is the answer on this question. I believe, that services directive will have a perceivable impact on the internal market, however, a major change in functioning of the internal market cannot be expected. It is mainly due to the fact that services directive doesn’t introduce any new instruments into the functioning of the internal market of services and all the amendments that it brings are rather a non substantial ones.
