The Principle of Legal Certainty and its Role in the Rule of Law

Abstract:

Tato práce začíná představením různých konceptů právního státu od nejširších až po ty nejužší. Toto představení je založeno na filozofické a komparativní analýze principů spojovaných s právním státem, tím nejdůležitějším je princip právní jistoty. Na rozboru judikatury českých soudů ukazuje, že princip právní jistoty sám nesplňuje kritéria, která klade na zbytek právního řádu, neboť jeho aplikace není jednotná. Dále práce představuje teorii, dle níž je rozdíl, jestli je vágnost obsažena v hypotéze anebo v dispozici právní normy, přičemž vágnost v dispozici je probletičtější. Následuje argumentace, že by na základě konceptu precedenční závaznosti judikatury mělo dojít v kontinentálních právních systémech k revizi formálních pramenů práva a zařazení judikatury jako jednoho z nich. Poslední kapitola práce navrhuje způsoby, jak může soudní moc systematicky působit na moc zákonodárnou za účelem lepší normotvorby.

Abstract:

This thesis starts with elaboration on different concepts of the rule of law from the broadest to the most narrow. It is based on a philosophical and comparative analysis of principles inherent to it, the principle of legal certainty being the prominent one. It is shown on the analysis of the case law of the Czech Republic that the concept of legal certainty is not by itself meeting the criteria it places on the rest of legal order as its application is not uniform. Furthermore, the thesis proposes a theory of division between vagueness in factual conditions and normative consequences of legal norms, the latter being more problematic. The thesis then analyzes the precedential binding effect of case law and argues that the system of formal sources of law should be reworked in civil law systems to include case law. The last chapter of the thesis proposes ways in which judiciary can systematically incentivize legislator to produce better quality of legal provisions through separation of powers.
