Abstract:

Diplomová práce se zabývá institutem občanského práva bezdůvodným obohacením. Práce nabízí představení institutu bezdůvodného obohacení se zaměřením na popis a vysvětlení významu jednotlivých skutkových podstat bezdůvodného obohacení z hmotněprávního i z procesněprávního hlediska. Hlavním cílem práce je popsat jednotlivé aspekty institutu bezdůvodného obohacení, které jsou uvedené v ustanoveních § 2991 - § 3005 zákona č. 89/2012, občanského zákoníku. Dílčím cílem práce je též vyhodnocení uváděného popisu. Těchto cílů bylo dosaženo rešerší dostupné relevantní literatury, analýzou související judikatury a právních předpisů a uvedením názorných příkladů z praxe. Text práce je rozdělen do čtyř logicky propojených částí. V první z nich je probírán historický vývoj právní úpravy bezdůvodného obohacení se zaměřením na římské právo, Obecný zákoník občanský z roku 1811 a československé občanské zákoníky z let 1950 a 1964. Dále je v první části představena i platná česká právní úprava. Závěr první části se věnuje subsidiaritě bezdůvodného obohacení. Druhá část se věnuje celkem pěti skutkovým podstatám bezdůvodného obohacení. Jsou v ní popsány jejich jednotlivé aspekty, diskutovány jejich vzájemné souvislosti i souvislosti s jinými ustanoveními či právními normami. Třetí část práce se věnuje právu na vydání bezdůvodného obohacení. Detailně je zde diskutován jednak způsob a rozsah vydání bezdůvodného obohacení a jednak promlčení práva na vydání bezdůvodného obohacení. V poslední čtvrté části práce jsou porovnávány právní úpravy bezdůvodného obohacení v Česku, Rakousku a Německu.

Abstract:

This thesis deals with a civil law institute of unjust enrichment. The thesis offers introduction of the unjust enrichment institute with an orientation on description and explanation of each fact of a case from points of view of material and procedural law. Main goal of the thesis is to describe each aspect of the institute of unjust enrichment stated in § 2991 - § 3005 of law n. 89/2012 Sb., Civil Code. Partial goal of this thesis is also to evaluate stated descriptions. To achieve these goals a research of available relevant literature, analysis of related practice of the courts and legislation and presentation of demonstrative practical examples were performed. Text of the thesis is divided into four logically connected parts. In first of them, the historical development of legislation related to unjust enrichment is discussed. Attention is aimed to ancient Roman law, General civil code from 1811 and Czechoslovakian civil codes from 1950 and 1964, respectively. Next the first part legislative currently in effect is introduced. Conclusion of the first part is devoted to subsidiarity of unjust enrichment. Second part of the thesis is devoted to five facts of cases of unjust enrichment in total. Their individual aspects are described and their mutual relations and relations to other provisions or regulations are discussed. Third part of the thesis is devoted to right to be handed out the unjust enrichment. Manner and extent of handing out the unjust enrichment on the one hand and statute of limitation of the right to be handed out the unjust enrichment on the other hand are discussed in detail. In last and fourth part of the thesis legislations in Czechia, Austria and Germany are compared.
