The reflection of totalitarism in Czechoslovak legislation of 30s 20th century

Abstract:

Předmětem disertační práce je období 30. let 20. století Československé republiky, které je mnohdy obecně vnímáno jako zlatý věk, byť s pozdějším tragickým koncem. Cílem této práce je poznání, jaká opatření byla v demokratickém Československu 30. let 20. století přijata k odvrácení nebezpečí hrozícího ze strany zahraničních totalitních ideologií. Konkrétně jde o poznání, nakolik totalitarismus se silnými vůdci, pevnou mocenskou strukturou a omezenými právy svých občanů ovlivňoval demokratické rozhodovací mechanismy v První republice, spolu s analýzou přijatých restriktivních a cenzurních opatření. Práce se člení na čtyři hlavní kapitoly, přičemž v jednotlivých podkapitolách a oddílech jsou právní normy rozebírány v lineární časové posloupnosti, se zaměřením na normy zákonné, ovšem nejsou opomenuty ani prováděcí předpisy a podzákonné normy, klíčové pro ilustraci popisovaných poměrů.

Abstract:

There is being considered as the subject of this dissertation the time period of 30th years of 20th century of Czechoslovak Republic, which is frequently generally accepted and comprehended as the golden age, even if with the later tragic end. The theme of Czechoslovakia of 30th years of 20th century seems to be extremely large one and from this reason should be surely contributive and benefit to scrutinize it, i.e., in the context of contemporary events, what the entire accepted legislative concern. The content of this substance could exceed manifold the scope possibility of this dissertation thesis. The dissertation thesis is being structured into four main chapters, whereas in the individual subchapters and sections have been the legal norms analysed in the linear time sequence with the concentration on the legal norms, whereas have not been omitted neither the implementary regulations and sub-statutory norms, which are being foreseen as the pivotal ones for the depicting of described circumstances. The thematic norm selection has been little bid narrowed with the respect to the scope of this dissertation thesis, nevertheless the interpretation signification of them has stayed as not shortened. The efficiency of the individual norms and the interpretation of them are being investigated and scrutinised carefully, namely through the contemporary jurisprudence and through the contemporary archive sources. There are being considered as the subject of investigation the acceptance processes and consequently modification and alteration of the legal regulations and the contemporary context of them as well.
