Abstract:

V praxi Policie činí nemalé problémy prokazování některých typů trestné činnosti. Jedná se zejména o organizovanou trestnou činnost. Jelikož opatřování důkazů souvisejících s organizovanou trestnou činností je nelehkou záležitostí, zejména proto, že osoby opatřující si pornografii, uživatelé drog, kupující dítě či ženu, osoby peroucí špinavé peníze a uplácející osoby, se necítí být ve věci poškozenými a ve většině případů se ba naopak na páchání trestné činnosti podílejí. S ohledem na tyto skutečnosti je zapotřebí, pro boj proti této kriminalitě, policejní orgán podpořit i po stránce právní, za účelem získání informací důležitých, pro případné trestní řízení. Tématem této práce je policejní provokace, operativně pátrací prostředky a zjišťování trestné činnosti v praxi Policie ČR. Při policejní provokaci dochází ke dvěma protichůdným problémům. Jedním je dodržení zákonnosti v souladu s Listinou základních práv a svobod, Ústavy a nadnárodními předpisy, kterými je Česká republika vázána a na straně druhé zájem společnosti potrestat pachatele závažné trestné činnosti. Tímto se dostáváme do střetu zájmů, kdy se do konfliktu dostává právní zájem většiny s právy jednotlivce. Při ospravedlňování policejní provokace bývá nejčastěji odkazováno na komplikovanost odhalování trestných činů, kdy agenta lze využít pouze v případě, že se jedná o zvlášť závažný zločin, kdy tento je definován v trestním zákoníku jako trestný čin, na něž trestní zákoník stanoví trest odnětí svobody s horní hranicí trestní sazby nejméně deset let. Operativními pátracími prostředky jsou předstíraný převod, sledování osob a věcí a použití agenta. K těmto operativně pátracím prostředkům upraveným trestním řádem jsou nápomocny podpůrné operativně pátrací prostředky v zákoně o Policii České republiky. Jedná se o informátora, krycí prostředky, zabezpečovací techniku, zvláštní finanční prostředky. Použitím těchto prostředků dochází k zásahu do osobních práv a svobod, proto podléhají schvalovacímu procesu. Značná část úpravy použití operativně pátracích činností je upravena interními předpisy. Bylo by vhodné toto upravit přímo v trestním řádu společně s podpůrnými operativně pátracími prostředky ze zákona o Policii České republiky, avšak některá ustanovení podpůrné operativně pátrací prostředky by měli pro případ potřeby zůstat v zákoně o Policii České republiky zachovány.

Abstract:

In praxis, police has serious problems proving some kinds of criminality, mainly organized crime. Procurement of evidence related to the organized crime is quite difficult due to the fact, that persons obtaining pornography, drug users, persons buying a child or a woman, individuals involved in money laundring or bribing, do not feel to be aggrieved and in many cases they are participating in the criminal act. Considering this fact it is important to support police in fighting against crime in legal terms, so they can obtain the informations important for potential criminal procedure. This thesis deals with police provocation, operational means of searching and discovery of criminal acts in Police of the Czech Republic praxis. In terms of the police provocation, there are two contradictory problems. The first is keeping the provocation in compliance with the Bill of Rights, the constitution and supranational regulations which the Czech Republic is bounded by. The second is the public interest to punish the perpetrator of serious criminal act. This brings the conflict of interests, because there is a conflict between the public interest and individual rights. When justifying the police provocation the references to difficulties regarding the revelation of criminal acts are often used. The agent can be used only in case of serious crime, that is defined as a crime, which could be, regarding to the criminal code, sentenced by imprisonment up to at least ten years. Operational means of searching include fake transfer, persons and objects monitoring and the usage of an agent. In addition to these operational means of searching regulated by the criminal code there are supportive operational means of searching defined in the Czech Republic’s police law. These include the informer, covering means, security systems and special funds. The usage of these means intervenes with individual rights, therefore it has to undergo approval process. Many uses of operational searching acts are regulated by internal regulations. It would be appropriate to regulate this directly in the criminal code together with the Czech Republic’s police law operational means of searching, but some of the supportive operational means of searching should remain in the Czech Republic’s police law for use in case of need. Discovery of criminal acts in Czech Republic’s police praxis is divided into two parts - the discovery of criminal acts before prosecution and after prosecution. These two mutually connected topics are regulated by §158 section 1 and §164 of the criminal code. These paragraphs also contain the responsibilities of police and supposed procedures in these cases.
