Examination urgent and non-recurring act at penal proceedings

Abstract:

Význam ohledání pro proces odhalování, vyšetřování a předcházení trestné činnosti je značný. Prostřednictvím ohledání se zjišťuje a zkoumá podstatná část důležitých stop trestného činu i jeho pachatele, kriminalisticky relevantních událostí a příčin jejich vzniku. Výsledky ohledání, zvláště pak ohledání místa činu, dovolují orgánům činným v trestním řízení správně stanovit a určit zaměření další činnosti při odhalování, vyšetřování a předcházení trestné činnosti. Na ohledání jeho neodkladnost a neopakovatelnost se můžeme dívat jak z hlediska trestně právního, tak z hlediska kriminalistického, přičemž se tyto pohledy vzájemně prolínají, navzájem se doplňují a navazují na sebe. Z kriminalistického hlediska jsou neodkladnost a neopakovatelnost základní zásady ohledání společně se zásadou nezastupitelnosti a zásadou řízení ohledání jedním vedoucím. Z těchto zásad také kriminalistická teorie a praxe vychází při dalším rozpracování a zdokonalování taktiky ohledání a jeho praktickém provádění. Kriminalistická praxe rozdělila ohledání na dvě nejdůležitější kategorie a to podle charakteru ohledávaného objektu a podle posloupnosti, dále stanovila obecné a výše uvedené základní zásady ohledání. Ohledání místa činu je základní a nejfrekventovanější metodou používanou praxí. Průběh rozdělujeme do fází přípravy, orientačního a detailního ohledání, závěrečné fáze a nezbytného vyhodnocení ohledání. Jako základní metody je při ohledání využito pozorování a následují další obecné vědecké metody, ale i metody specifické pro kriminalistickou činnost. Pro dokumentaci ohledání jsou zákonem stanovené předpoklady. Obligatorně je vyžadován protokol o ohledání, fotodokumentace, náčrtek případně plánek. Možné jsou další doplňkové druhy dokumentace jako je video dokumentace, zvláštní druhy topografické dokumentace atd. Významným přínosem pro kriminalistickou činnost bude zavedení digitální fotografie pro dokumentaci ohledání, přičemž dosavadní právní úprava postačuje pro zachování procesní hodnoty digitální fotografie a její nezpochybnitelnost v trestním řízení. Výhody digitální fotografie jsou nesporné a převyšují nad nevýhodami jako je problém archivace dat a náročnost na technické vybavení. Z pohledu trestně právního je neodkladnost a neopakovatelnost procesního úkonu přesně definována trestním řádem, netýká se pouze samotného úkonu, ale týká se i nositele informace (důkazního prostředku), nebo informace (důkazu) samotné. Provádění neodkladných a neopakovatelných úkonů je nutno věnovat zvýšenou pozornost, neboť splnění podmínek neodkladnosti, nebo neopakovatelnosti podle trestního řádu, je předmětem přezkoumání soudem v rámci předběžného projednání obžaloby a v hlavním líčení. Z pohledu práva musíme od sebe vždy odlišovat neodkladnost a neopakovatelnost. Ohledání provedené před sepsáním protokolu o zahájení trestního stíhání splňuje jak podmínku neodkladnosti tak neopakovatelnosti tohoto úkonu.

Abstract:

The examination is of the outmost importance in the crime detection, investigation and prevention processes. An essential part of significant traces of the crime and the offender as well as criminal events and their causes are found out and examined as a result of the examination. The outcomes of the examination, in particular of the crime scene examination, may enable the bodies in charge of criminal proceedings to determine and specify adequately the direction of further activities in the course of the crime detection, investigation and prevention. The examination and its exigent and unrepeatable aspects may be assessed with respect to criminal law and to criminology according to their mutual cross-over, complementation and sequence. The criminological point of view declares the exigent and unrepeatable aspects together with the infeasibility of replacement and of change in the inspection manager to be the fundamental principles. The subsequent execution of the inspection and the improvement in the inspection tactics are based on these principles of criminological theory and practice. The criminological practice divides the examination into two most significant categories according to the nature of the subject under inspection and to the sequence. Moreover, it has specified general and above-mentioned fundamental examination principles. The crime scene examination is the basic and the most frequently applied method in the practice. The course of crime scene examination is divided into the stages of preparation, general and detailed examination, final stage, and indispensable examination assessment. As the basic method in the process of inspection, the observation has been applied together with other general scientific methods and the methods specific for criminology. As for the documentation of the examination, the law determines the prerequisites, while a report on examination, photo documentation, a sketch or a plan are being obligatorily required. Other supplementary types of documentation such as video documentation, special kinds of topographic documentation, etc. are also acceptable. The introduction of the digital photograph will become a significant contribution to the criminology practice in the inspection documentary process; whilst in compliance on current legislation, the digital photograph and its trustworthiness in the criminal proceedings are sufficient for preserving the process value. There are no doubts concerning the advantages of the digital photograph and they prevail against potential disadvantages, such as the data filing problems and expensiveness of the technical equipment. From the view of the criminal law , the exigent and unrepeatable character of the process act is defined by the Rules of Criminal Procedure, and this does not only concern the act itself, but also the information carrier (means of evidence), or the information itself (evidence). The execution of exigent and unrepeatable acts shall require increased attention, because in compliance with the Rules of Criminal Procedure, the implementation of the conditions of the exigent and unrepeatable aspects is subject to the reviewing made by the court within the preliminary hearing of the indictment and within the trial. From the aspect of the law, the exigent and unrepeatable aspects have to be always distinguished from each other. Thus, the examination carried out before the report of commencement of criminal prosecution has been written shall satisfy the conditions of providing both the exigent and unrepeatable aspects of this act.
