The legislative process in the European Union

Abstract:

Tato práce se zabývá legislativním procesem v Evropské unii. Popisuje tedy proces přijímání právních aktů na evropské úrovni. Legislativní proces v Evropské unii je komplexní záležitost, tedy práce zohledňuje veškeré jevy, které ovlivňují legislativní proces. Všechny okolnosti legislativního procesu a legislativní proces samotný je popsán chronologicky od počátků evropské integrace až po současné fungování Evropské unie na základě aktuálně platné Lisabonské smlouvy. Teoretická kapitola se zabývá teorií evropské integrace a vývojem evropského integračního procesu. Práce představuje dvě základní paradigmata evropské integrace, paradigma nadnárodní a mezivládní, která ovlivňovala vývoj evropského integračního procesu. Další část práce se zabývá institucemi Evropské unie. Mezi hlavní instituce, které jsou zapojeny do legislativního procesu, patří Evropská komise, Rada Evropké unie a Evropský parlament. Práce popisuje jejich vývoj, složení, pravomoci a způsob rozhodování. Další část práce se zabývá prameny práva Evropské unie a jejich vymezením. Poslední část práce se zabývá legislativními procedurami Evropské unie, kterými jsou přijímany právní akty. Tato část práce se zabývá podobou legislativních procedur před a po vstupu Lisabonské smlouvy v platnost. Na základě aktuálně platné Lisabonské smlouvy a změn, které přinesla, odpovídám na otázku, jak její přijetí přispělo ke směřování Evropské unie podle principů nadnárodního paradigmatu a jaké konkrétní změny k tomuto směřování přispěly.

Abstract:

This work deals with the legislative process in the European Union. Therefore describe the process of adopting legislative acts at European level. The legislative process in the European Union is a complex issue, therefore, takes into account all the phenomena that influence the legislative process. All the circumstances of the legislative process and legislative process itself are described in chronological order of European integration to the current functioning of the European Union under the currently adopted by the Lisbon Treaty. The theoretical chapter deals with the theory of European integration and the development of the European integration process. I present two basic paradigms, the supranationalism and intergovernmentalism, which influenced the development of European integration. I describe the features of these paradigms and their subtypes, and also deal with the development of European integration, which flowed over the two paradigms. The next chapter deals with the EU institutions. Among the main institutions that have an impact on the legislative process are the European Commission, Council of the European Union and the European Parliament. I describe their development, composition, powers and decision-making. Proposals for legislative acts are created by the European Commission and the decisions of a legal act involving the Council of the European Union and European Parliament. The next chapter deals with the sources of EU law and their definitions. Each section describes changes after the adoption of the Lisbon Treaty currently in force. The last chapter deals with the legislative procedures, which are accepted by the legal acts. The main procedures before the Lisbon Treaty was the procedure of consultation, co-operation, co-decision and assent. Following the adoption of the Lisbon Treaty is in force the co-decision procedure, which is now called the ordinary legislative procedure. Based on the changes brought by the Lisbon Treaty, indicate the extent to which the Lisbon Treaty has contributed to the direction of the European Union under the principles of supranationalism paradigm, and what specific changes have contributed to this trend.
