The Analysis of the Article 52 the ICSID Convention Namely from the Viewpoint of the Annullment of an Arbitration Award

Abstract:

Mezinárodní investiční arbitráž při středisku ICSID je nejrozšířenějším prostředkem pro řešení sporů z investic, který je aplikovatelný v téměř celosvětovém měřítku. Tato instituce stojí na základě Washingtonské úmluvy o řešení sporů z investic mezi státy a občany druhých států. Předmětem této práce je článek 52 této úmluvy, který se zabývá zrušením rozhodčího nálezu na základě vážných procesních pochybení. Tento článek je zkoumán prostřednictvím vyložené judikatury, což napomáhá lepšímu praktickému pochopení této problematiky.

Abstract:

International Investment Arbitration judged by ICSID center is the most spread arbitration bar for resolving International Investment disputes, which is applicable almost worldwide. This institution is based on the Washington convention on the Settlement of Investment Disputes between States and Nationals of Other States. The subject of this thesis is an analysis of article 52 of this convention, which is dealing with an annullment of the decision of the tribunal. This article is analyzed through jurisprudence, which helps the easier practical understanding of this topic.
