Selected Competition Law- and Contract Law Issues of Sharing Economy

Abstract:

Diplomová práce se zabývá vybranými soutěžněprávními a smluvněprávními problémy spojenými se sdílenou ekonomikou. Nejprve je vymezen pojem sdílené ekonomiky obecně a potom pro účely této práce. Dále jsou uvedeny příklady komerčních a nekomerčních platforem „sdílené ekonomiky“ a je posouzeno, zda se vyskytují soutěžněprávní a smluvněprávní problémy v obou těchto sektorech. Těžištěm práce je posouzení soutěžněprávních problémů spojených s dominantním postavením platforem „sdílené ekonomiky“ a zkoumání smluvněprávních problémů spojených s povahou smluvních vztahů mezi podnikatelskými a koncovými uživateli platformy, a mezi platformou a podnikatelskými uživateli. Práce pracuje s aktuální i chystanou regulací spojenou s platformami „sdílené ekonomiky“, která je v závěru soutěžněprávní i smluvněprávní části kriticky okomentována.

Abstract:

The diploma thesis deals with selected competition law and contract law problems associated with the sharing economy. First, the concept of sharing economy is defined in general and then defined for the purpose of this thesis. The examples of commercial and noncommercial "sharing economy" platforms follows and it is further assessed whether there are competition and contractual issues in both of these sectors. The thesis is focused on the assessment of competition law problems associated with the dominant position of "sharing economy" platforms and the examination of contractual law problems related to the nature of contractual relations between business- and end-users of the platform and between the platform and business-users. The current and planned regulation associated with the "sharing economy" platforms is analysed in the thesis and finally, critical commented at the end of each section.
