Abstract:

Tato práce se zabývá výjimečným trestem odnětí svobody, kterým se podle současné právní úpravy rozumí trest odnětí svobody nad 20 do 30 let a trest doživotí. Pojednává o podmínkách, které musí býti splněny, aby soud mohl takový trest uložit. Dále rozebírá diferenciace, jež se vyskytují v trestním řízení a ve výkonu trestu v případech, kdy se ukládá výjimečný trest. V práci bude poukázáno na problémy, kterým ve věznicích musí čelit jak odsouzení, tak vězeňský personál. Opomenuta nebude ani historie dříve nejpřísnější trestní sankce, trestu smrti, v krátkém historickém exkurzu a nakonec nebude chybět kazuistika vybraného případu, který bude rozebrán ve světle judikatury.

Abstract:

This thesis deals with the extraordinary punishment of imprisonment, which means imprisonment from 20 to 30 years and life sentence by the actual legal regulation. It is focused on the conditions that must be fullfillment for imposing such a penalty. In another part of the thesis the attention is focused on analyzes the differentiations that are in criminal proceedings and the execution of sentences in extraordinary punishment case law. The thesis points to the problems of convicted prisoners and prison staff in prisons. The thesis also contains the earlier strictest criminal sanctions - the death penalty in a short historical excursion, and the analysis report of the case which will be dissected in the light of the case law.
