International Criminal Tribune for Rwanda: The Institutional Structure and Selected Decisions

Abstract:

Má diplomová práce se zabývá Mezinárodním trestním tribunálem pro Rwandu. Zaměřuje se zejména na jeho institucionální strukturu a jeho vybranou judikaturu. Struktura mé diplomové práce je následující: - v první řadě má práce předestírá historické pozadí rwandského konfliktu, kde ukazuje porušení nejzákladnějších pravidel mezinárodního práva, zejména v oblasti páchání genocidy a porušení ženevských konvencí. - dále má práce poukazuje na vývoj mezinárodních trestních tribunálů od II. světové války, zejména pak na Norimberský tribunál. Přestože byly tyto tribunály po dlouhá léta jedinými trestními tribunálu na světě, v 90. letech 20. století vznikly další dva mezinárodní trestní tribunály, jako reakce na hrůzné činy, jež se tou dobou staly na území bývalé Jugoslávie a ve Rwandě. Mezinárodní trestní tribunál pro Rwandu vznikl rezolucí rady bezpečnosti. O několik let později vznikl stálý Mezinárodní trestní tribunál, jemuž základ položil Římský statut. Mezinárodní trestní tribunály tedy můžeme rozdělit na: - stálé (ICC) - ad hoc tribunály (ICTR,ICTY) Má diplomová práce věnuje pozornost také mezinárodnímu trestnímu tribunálu pro bývalou Jugoslávii a snaží se najít společné cíle s ICTR. Dále také poukazuje na určité rozdíly, které lze mezi těmito dvěma sesterským i tribunály spatřit. Hlavním jádrem mé práce je institucionální struktura ICTR a jeho analýza. Právní základ Mazinárodního trestního tribunálu pro Rwandu je tvořen jeho Statutem, který budu ve své práci rozebírat a popisovat.

Abstract:

This thesis deals with the International Criminal Tribunal for Rwanda. Its focus is predominantly upon the institutional structure and selected judgments of the court. The structure of the thesis is as follows. - First, the thesis presents the historical background of the Rwanda conflict that led to a number of breaches of the most fundamental rules of international law, including the prohibition of genocide and the Geneva conventions. - Second, the thesis highlights the evolution of international criminal tribunals since the World War II. It further elucidates that the Nuremberg and Far East tribunals present milestones in this respect. However, these were the only international criminal tribunals in the world for many years. Third, no later than in the 1990's, and as a reaction to atrocities in the former Yugoslavia and Rwanda, the international community gave rise to new tribunals of international criminal justice. Quite unsurprisingly, the United Nations were perceived as an ideal platform for establishing of new international criminal tribunals. The legal vehicle for doing so was the two Security Council Resolutions in 1994 and 1995. Few years later, the Rome Statutes became the legal basis for the permanent international criminal tribunal, indeed International Criminal Court. Hence the international criminal tribunals may be divided essentially into two kinds: - permanent and those of - an ad hoc nature. The latter are therefore confined to a particular conflict during the limited period of time. The thesis pays heed to the closeness of the tribunals for the former Yugoslavia and Rwanda, and therefore seeks to describe their common features, as well as the most important differences. Subsequently, the institutional structure of the ICTR is analysed. The legal basis of the court is the Statute. It is thus of an utmost importance to analyse the provisions of the Statute in order to explain properly the functioning of the court.
