Appeal in the foreign exchange law

Abstract:

Anotace: Předmětem bakalářské práce „Rozklad v devizovém řízení“ je představení institutu rozkladu jako řádného opravného prostředku v řízeních před orgány devizové správy v devizových věcech a zároveň posouzení jeho vhodnosti. První část práce se věnuje orgánům devizové správy a dále správnímu řízení a opravným prostředkům, které se v něm užívají, včetně rozkladu. V druhé části je představeno užití rozkladu proti rozhodnutím devizových orgánů, přezkum rozhodnutí správním soudnictvím a také lhůty, které se vztahují pro užití opravných prostředků. V poslední části práce jsou vytvořeny vzory rozkladu a shrnuty poznatky a návrhy na změny stávající právní úpravy.

Abstract:

Abstract: The goal of the submitted thesis „Appeal in the foreign exchange law“ is to present the institute of appeal, as a regular amendatory instrumentality in administrative proceedings before authorities of foreign exchange administration in causes of foreign exchange and equally consider the fitness of appeal. The first part of the thesis is concentrated on authorities of foreign exchange administration, administrative proceedings and amendatory instrumentalities, which are used, including appeal. In the second part of the thesis is presented the application of appeal against the decision of authorities of foreign exchange administration, review of the decision at administrative judiciary and also terms, which do apply for usage of amendatory instrumentalities. In the last part are modelled examples of appeal and summarizes findings and proposals for changes in the current legal adjustment.
